These Terms of Service ("Terms") govern your use of Ember VPN ("the Service"), operated by Ember Labs ("we", "us", "our"). By downloading, installing, or using Ember VPN, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Ember VPN is a virtual private network service that encrypts your internet traffic and routes it through secure servers in multiple countries. The Service is designed to protect your privacy and secure your internet connection.
You must be at least 13 years old to use Ember VPN. By using the Service, you represent that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian.
Your account is tied to a device identifier generated upon first use. You are responsible for maintaining the security of your device and account. You agree not to share, transfer, or sell access to your account.

We may suspend or terminate your access to Ember VPN at any time, without prior notice, if we reasonably believe you have violated these Terms. Specifically:
Upon termination, your right to use the Service ceases immediately. Any data associated with your account will be deleted in accordance with our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT GUARANTEE ANY SPECIFIC LEVEL OF SPEED, AVAILABILITY, OR UPTIME.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EMBER LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Ember Labs, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
We may revise these Terms from time to time. Material changes will be communicated through the app or on our website. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
